Terms of Use
These terms are the agreement between you and Ian Magee, London, United Kingdom, for use of the Memodate iPhone app. By downloading or using the app, you accept them.
Your licence
You get a personal, non-exclusive, non-transferable licence to use Memodate on Apple devices you own or control, for your own non-commercial use. The app and its content stay the property of Ian Magee. You may not copy, resell, rent, reverse engineer or redistribute it, except where the law says you may.
Subscriptions
Memodate Plus is sold as an auto-renewing subscription through Apple: £2.99 a week, £6.99 a month or £69.99 a year. Chapter 1 is free without a subscription.
Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically unless you cancel it at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours of the period ending. You manage and cancel subscriptions in your Apple Account settings on your device, not in the app. Deleting the app does not cancel a subscription.
Free trial
A new subscription may include a 7-day free trial. The trial converts into a paid subscription at the price shown unless you cancel at least 24 hours before it ends. If you buy a subscription while a free trial is running, the unused part of the trial is forfeited.
Prices and changes
Prices may change. A change to the price of an existing subscription only takes effect after notice, and Apple will ask you to agree where required. Features may be added, changed or removed as the app develops.
Refunds
All purchases go through Apple, so refunds are handled by Apple under the App Store terms. Ian Magee cannot issue refunds directly. Request one at reportaproblem.apple.com. Nothing here affects any statutory rights you have as a consumer.
No guarantee of results
Memodate teaches a memory technique. How well it works depends on you: how often you practise and what you practise. No particular improvement in memory, exam result or performance is promised, and the app is not medical advice or treatment for any condition affecting memory.
Acceptable use
Do not use the app unlawfully, do not try to break, overload or gain unauthorised access to its servers, do not attempt to bypass payment or unlock paid content, and do not upload content into your account that is unlawful or infringes someone else’s rights. An account may be suspended or closed if these terms are broken.
Availability
The app is provided as is. Reasonable care is taken to keep it working, but it is not promised to be uninterrupted or error free, and it may be unavailable during maintenance or because of problems at a third-party service it relies on.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Beyond that, and to the extent the law allows, there is no liability for indirect or consequential loss, loss of data, or loss of profit, and total liability for any claim is limited to the amount you paid for the app in the twelve months before the claim arose.
Apple
Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide support for the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Privacy
How your data is handled is set out in the privacy policy, which forms part of these terms.
Ending the agreement
You may stop using the app and delete your account at any time from Settings inside it. The licence ends when you do. Terms that by their nature should survive, such as liability and governing law, continue to apply.
Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer elsewhere, you keep the protections of the mandatory law of the country you live in.
